Developer Panel — SquareFeetConnect
Effective Date: Sep 2026 Version: 1.0These Terms of Service ("Terms") govern access to and use of the SquareFeetConnect Developer Panel ("Panel") by real estate developers, builders, and their authorised representatives ("Developer", "you"), and all engagement, coordination, and transactions facilitated between the Developer and SquareFeetConnect. By registering a Developer Panel account, listing a project, or otherwise engaging with SquareFeetConnect, you confirm that you have read, understood, and agree to be bound by these Terms, and that you have the authority to bind the Developer entity you represent.
SquareFeetConnect acts strictly as an intermediary, marketing coordinator, and lead-facilitation platform connecting the Developer with prospective buyers, investors, and their advisors. SquareFeetConnect does not co-develop, guarantee sales of, underwrite, or take on any ownership, construction, or delivery obligation in respect of any project listed on the Panel. SquareFeetConnect does not provide legal, regulatory, or financial advice to the Developer and does not warrant customer conversion, sale volumes, or transaction completion.
Access to the Developer Panel requires registration and verification, including submission of company KYC documents (such as PAN, GST registration, Certificate of Incorporation), RERA registration certificate(s) for each listed project, and details of the authorised signatory or representative operating the account. You agree to keep this information current and to promptly notify us of any change in authorised representatives, project status, or registration details.
You are responsible for all activity conducted through your Developer Panel account and must keep login credentials confidential. SquareFeetConnect may suspend or deactivate a Developer account where information provided is false, incomplete, or outdated, or where compliance or security risks arise.
All project details uploaded to the Panel — including pricing, layouts, specifications, approvals, RERA registration status, possession timelines, and any representations or commitments — are provided by the Developer and remain the sole responsibility of the Developer. SquareFeetConnect does not independently verify project data beyond reasonable checks of documents submitted at registration and relies on the Developer for accuracy, completeness, and continued validity.
The Developer warrants that it holds all approvals, permissions, and registrations (including under the Real Estate (Regulation and Development) Act, 2016) required to market and sell the listed project, and that listed information will be updated promptly to reflect any material change, including in pricing, timelines, or regulatory status.
SquareFeetConnect may market listed projects, arrange site visits, and share prospective customer leads and enquiries received through the Panel or otherwise with the Developer for the purpose of facilitating a transaction. The Developer agrees to engage with shared leads professionally, in good faith, and within a reasonable time, and not to bypass SquareFeetConnect to avoid applicable brokerage or commission where a lead was introduced by SquareFeetConnect, except as otherwise agreed in writing.
SquareFeetConnect does not guarantee the volume, quality, or conversion of leads shared with the Developer.
Brokerage, commission, or other fees payable to SquareFeetConnect by the Developer shall be governed by a separate mutual agreement executed between the parties, setting out applicable rates, milestones, invoicing, and payment timelines. Amounts shall be exclusive of applicable taxes (including GST) and subject to applicable TDS, unless otherwise agreed. Any dispute regarding commission attribution (including lead source or first point of contact) shall be resolved in accordance with the records maintained by SquareFeetConnect and the separate commercial agreement between the parties.
The Developer shall at all times comply with applicable law, including the Real Estate (Regulation and Development) Act, 2016 and rules made thereunder, applicable municipal and planning regulations, and consumer protection law. The Developer shall indemnify and hold SquareFeetConnect harmless from any claim, loss, penalty, or liability arising from inaccurate project information, non-compliance, project delay, or any act or omission of the Developer or its representatives, contractors, or agents.
The Developer retains ownership of project images, brochures, floor plans, videos, and other marketing content it uploads to the Panel ("Developer Content"), and grants SquareFeetConnect a non-exclusive, royalty-free licence to use, reproduce, and display Developer Content for the purpose of marketing the project through the Panel, our website, and associated channels, for so long as the project remains listed and for a reasonable period thereafter for record and reference purposes.
All other intellectual property comprised in the Panel, including branding, software, layouts, logos, and platform materials, remains the exclusive property of SquareFeetConnect. No such material may be copied, reproduced, or reused by the Developer without prior written consent.
Customer and lead information shared with the Developer through the Panel is provided strictly for the purpose of pursuing the specific transaction and must be treated as confidential. The Developer shall not sell, rent, further share, or use such information for any purpose unrelated to the facilitated transaction, and shall implement reasonable safeguards to protect it, consistent with applicable data protection law.
SquareFeetConnect may suspend or delist a project, or suspend or terminate a Developer Panel account, where information provided is found to be false, forged, or misleading, where regulatory approvals lapse or are suspended, where the Developer breaches these Terms, or where continued listing poses a compliance or reputational risk. Outstanding obligations (including accrued brokerage) shall survive suspension or termination.
SquareFeetConnect reserves the right to modify, suspend, or discontinue the Developer Panel or any services, in whole or in part, without prior notice due to regulatory changes, force majeure events, business requirements, technical issues, scheduled or emergency maintenance, or operational constraints. Continued use of the Panel shall constitute acceptance of revised Terms.
Use of the Developer Panel, submission of project information or documents, and digital communication with SquareFeetConnect constitutes valid electronic consent under the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, to the extent personal data of the Developer's representatives is involved. Such data shall be handled in accordance with our Privacy Policy for Developers.
To the maximum extent permitted by law, SquareFeetConnect's total liability to the Developer, if any, shall be limited to the fees actually received by SquareFeetConnect from the Developer in respect of the specific listing or transaction giving rise to the claim. Indirect, consequential, or punitive damages are excluded.
The Developer shall indemnify, defend, and hold harmless SquareFeetConnect, its officers, employees, and representatives from and against any claims, losses, damages, or liabilities arising out of the Developer's project, its content, its representations, or its breach of these Terms or applicable law.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force. Failure to enforce any provision shall not constitute a waiver.
These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra.
By registering a Developer Panel account or engaging with our services, the individual accepting these Terms confirms that they are above 18 years of age, legally competent to contract, and duly authorised to bind the Developer entity to these Terms.
