Effective Date: Sep 2026 Version: 1.0
1. Introduction

This Privacy Policy governs the manner in which SquareFeetConnect, operating as an intermediary between property developers/builders and prospective buyers, investors, and other counterparties, collects, uses, stores, shares, safeguards, and disposes of information relating to developers, builders, and their authorised representatives who register or operate on the SquareFeetConnect Developer Panel ("Panel") ("Developer", "you"). By accessing the Panel, registering a Developer account, or engaging with our services, you acknowledge and consent to the practices described herein. In respect of the personal data of individual representatives of the Developer, SquareFeetConnect acts as a Data Fiduciary under the Digital Personal Data Protection Act, 2023.

2. Information We Collect

To register and operate a Developer Panel account and to list and market projects, we collect company and project information as well as personal information of authorised representatives, which may include: company PAN, GST registration, Certificate of Incorporation and other constitutional documents; RERA registration certificates and project approval documents; project brochures, floor plans, pricing sheets, and marketing content; bank account details for commission or payout processing; and the name, designation, contact number, email address, and identity proof of authorised signatories and representatives operating the Panel account.

3. Developer Panel Account & Usage Data

Where a Developer registers and uses a Panel account, we additionally collect login credentials (stored in encrypted form), listing and lead-management activity, communication records with prospective customers routed through the Panel, and general usage and device information (such as IP address, browser type, and access logs) required for account security, service continuity, and Panel improvement.

4. Lawful Basis for Processing

Personal data of the Developer's representatives is processed based on explicit consent, or where necessary for the performance of the Developer Panel Terms of Service, compliance with legal or regulatory obligations (including RERA-related verification), or other legitimate business purposes permitted under applicable law. Company and project-level information (which is not personal data) is processed under the Developer Panel Terms of Service and applicable regulatory requirements.

5. How Information Is Collected

Information is collected through the Developer Panel, our website, WhatsApp, email, phone calls, physical meetings, and authorised representatives of the Developer. All information is collected with knowledge and consent and processed strictly for legitimate business functions such as account and project verification, RERA and regulatory compliance checks, lead-sharing and marketing coordination, commission computation and payout, and communication regarding listed projects.

6. Sharing of Information

We store information on secure digital platforms including Google Drive, Office 365, Cloud Services, Email Servers, and CRM Systems, with access restricted to authorised personnel only. We do not sell, rent, or commercially exploit Developer or representative information. Project and marketing content is shared with prospective customers on the Panel and our website for the purpose of marketing the listed project. Company, KYC, and payout information may be shared with banks, payment processors, statutory auditors, legal advisors, or government/regulatory authorities strictly on a need-to-know basis or where legally required.

Certain cloud service providers engaged by us may store data on servers located outside India. Such cross-border storage is undertaken only with service providers implementing reasonable security safeguards, as permitted under applicable law.

7. Security Safeguards

We operate under the Digital Personal Data Protection Act (DPDP), 2023 and implement reasonable organisational and technical safeguards to prevent unauthorised access, alteration, loss, or misuse of Developer and representative data. These measures include access controls, encryption (where applicable), restricted sharing, internal confidentiality obligations, and time-bound data retention. To the extent permitted by law, SquareFeetConnect shall not be liable for breaches caused by third-party service providers, cyber incidents beyond reasonable safeguards, or disclosures mandated by government or judicial authorities.

8. Breach Notification

In the event of a personal data breach affecting Developer representative data, SquareFeetConnect shall take reasonable steps to contain, assess, and mitigate the impact and notify affected parties and authorities where legally required.

9. Automated Decision-Making

SquareFeetConnect does not engage in automated decision-making or profiling that produces legal or similarly significant effects on individuals. Lead-matching and marketing placement on the Panel are operational functions and do not constitute a legal or significant decision affecting the Developer or its representatives.

10. Data Retention

We retain Developer account information, project documentation, and representative personal data only for as long as necessary to provide services, comply with regulatory, taxation, audit, or dispute-resolution requirements. Typical retention periods may range between 3 to 8 years depending on the nature of the engagement and applicable RERA or tax record-keeping requirements. Data not required is deleted, anonymised, or archived securely. Developers may request access, correction, deletion, or withdrawal of consent in respect of representative personal data, subject to legal and contractual limitations. Withdrawal of consent may affect our ability to continue providing services or to maintain the Developer Panel account.

11. Communication Preferences

By interacting with us or the Panel, the Developer authorises SquareFeetConnect to communicate via the Panel, WhatsApp, SMS, email, or phone for account updates, verification queries, lead notifications, commission statements, and service coordination. Representatives may opt out of promotional communications at any time. Transactional and compliance-related communications may continue where required.

12. Changes to This Policy

Continued use of the Developer Panel or our services constitutes acceptance of this Privacy Policy. We reserve the right to update this document to reflect changes in law, regulation, technology, or business practices.

13. Data Handling

SquareFeetConnect follows an internal Data Handling Standard Operating Procedure ensuring purpose-bound and secure utilisation of confidential Developer and project information. Access is granted strictly on a need-to-know basis to authorised personnel and partners.

Documents, including RERA certificates, KYC records, and project files, are stored on secure cloud platforms with account-level and device-level security. Document sharing is limited in scope, purpose, and validity.

No employee or partner may download, duplicate, or forward Developer documents unless authorised and recorded. External storage devices are prohibited.

14. NDA with Vendors / Partners

All third-party vendors are bound by Non-Disclosure and Data Protection obligations prohibiting unauthorised use or sharing of Developer information and requiring breach notification within 48 hours.
